Facts of case
In 1919 the state of Pennsylvania passed a Sedition Act that aimed at reducing the rise of communism and other political rebellions against the state or government. The act declared engaging against violence of the state, or encouraging other too, illegal. In 1940, with the same intentions, the federal government passed the Smith Act. This deemed it a crime to publish or pass out material that advocated violence or overthrow of the government, among other regulations.
