Facts:
- The concept of zero tolerance means that there are no exceptions to the rule that it is applied on (example: If a student gets caught with a firearm, no matter the reason, they are automatically expelled for a year.)
- There is a lot of confusion about the definition of zero tolerance.
- Zero tolerance started in 1990 when Congress passed the Gun-Free Schools Act (mandates a one-year expulsion for any student caught with a firearm at school).
- It was followed by many other no-nonsense punishments all over the country.
- The law also directs states to allow school officials to modify the terms of expulsion “on a case-by-case basis”.
- States can limit local decision making by adapting more prescriptive laws.
- There is no clear line drawn in how local school leaders can apply zero tolerance.
