Dealing with the 5th Right
Double Jeopardy- Being tried for the same offense; prohibited by the 5th amendment to the U.S constitution (...."nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb"). It protects against three distinct abuses: [1] a second prosecution for the same offense after acquittal; [2] a second prosecution for the same offense after conviction; and [3] multiple punishments for the same offense. This is the courts legal definition, but should double jeopardy actually be prohibited in the U.S, by the constitution? Families of murder victims have broadly welcomed plans to allow someone acquitted to be retried where there is compelling evidence of guilt brought to the table. This bill should be made retrospect!
